450K Student Loans Forgiven: Who Qualifies Under Sweet v. McMahon?

A federal court ruling has protected automatic relief for borrowers covered by the $23 billion Sweet v. McMahon settlement.


Hundreds of thousands of student loan borrowers could have their federal debt canceled under this major class-action settlement involving people who said their colleges misled them.
 

Who is eligible for the latest automatic relief?

The settlement does not cover all federal student loan borrowers, and you generally cannot join the Sweet class by filing a new application now. Eligibility is based on when you filed your Borrower Defense to Repayment claim and which school you attended.

The settlement divides borrowers into three main groups:

  • Original class members: Borrowers who had a Borrower Defense application pending as of June 22, 2022, and attended one of more than 150 schools on the settlement list. These borrowers received automatic full relief beginning after the settlement’s November 2022 approval.

  • Post-class Exhibit C borrowers: Borrowers who filed a Borrower Defense application between June 23 and November 15, 2022, and attended a school on the settlement’s “Exhibit C” list. Because the Education Department failed to decide their applications by the January 28, 2026 deadline, they are entitled to automatic full relief.

  • Post-class non-Exhibit C borrowers: Borrowers who filed in the same June–November 2022 window but attended a school not on the Exhibit C list. Their deadline was April 15, 2026; those who didn’t receive a decision by then are also entitled to automatic relief.

A federal appeals court rejected the Education Department’s attempt to postpone its obligations, protecting automatic cancellation for roughly 200,000 additional borrowers whose claims weren’t decided on time.

What does full settlement relief include?

Eligible borrowers can receive:

  • Cancellation of the federal student loans connected to the school named in their borrower defense application.

  • Refunds of certain payments previously made to the Education Department.

  • Removal of negative credit information associated with the discharged loans.

Borrowers who received an approval notice should generally receive the full relief within one year of that notice. People covered by the automatic deadline provisions shouldn’t need to submit another borrower defense application to qualify.

They should make sure their contact information is current in their Federal Student Aid account and search their email, including spam and deleted folders, for messages from the Education Department.

People who didn’t file a borrower defense claim during the periods covered by Sweet aren’t automatically added to the settlement. They may still be able to submit an individual borrower defense application if they believe a college deceived them, but that new claim would be handled separately.

The recent ruling therefore doesn’t create forgiveness for all 450,000 borrowers at once. It ensures that the government must honor the settlement and provide the promised relief to borrowers who met its requirements.
